ATTENTION: THIS IS A LICENSE, NOT A SALE. THESE SERVICES ARE PROVIDED UNDER THE FOLLOWING LICENSE WHICH DEFINES WHAT USER MAY DO WITH THE SERVICES AND CONTAINS LIMITATIONS ON WARRANTIES AND/OR REMEDIES. 1) LICENSE GRANTED: These services are to be used exclusively by the end user and any subcontractors it may employ, for only the Identified Use and under the following terms:  a) The user may use the services to produce plots or reproduce maps for internal use only. Except as specifically described in the Identified Use, no digital data, or physical representations prepared in reliance on such digital data, may be reproduced or redistributed without the City\u2019s prior written permission. b) All plots, maps, copies, and other uses of the City\u2019s copyrighted services shall include a clearly legible note stating: COPYRIGHT CITY OF SUMTER, SOUTH CAROLINA © (year): [list services here (i.e. roads, boundaries, railroads, and hydrography)] c) The copyright and all other rights to the services shall remain with the City. d) The services may be distributed to only those involved in the Identified Use within the Licensee\u2019s firm and to Licensee\u2019s subcontractors provided that the City\u2019s copyright notice is included in every copy. e) When distributing said services, Licensee agrees to indemnify and hold harmless the City and its officers, employees, agents, contractors, and subcontractors against any claims or lawsuits arising from the use or distribution of the services as part of the products or services distributed by Licensee. f) Licensee is solely responsible for all technical support, if any, to any user of the products or services distributed. g) Licensee shall be responsible for insuring that all Licensee\u2019s employees and Licensee\u2019s subcontractors using the copyrighted services are advised of and understand the terms contained in this agreement. h) Licensee\u2019s subcontractors may use the services in their work for Licensee but may not use, or copy,  or retain, or distribute the services for any other purpose. i) Licensee and its subcontractors shall not copy, loan, or transfer the services, in whole or in part, to other public agencies or private individuals or firms unless prior written authorization and licensing is granted by the City. 2) LIMITATIONS: Licensee agrees not to use the services or make copies of them except as permitted in this License. Licensee agrees not to:  a) Rent, lease, assign, or transfer the services except as expressly allowed in this License.  b) Use services in published works for commercial use and/or sale. c) Redistribute, sell, or publish the services except as expressly allowed in this License.  3) TERM: This License shall continue for as long as User uses the services for their intended purpose. However, if Licensee fails to comply with any of the terms or conditions set out in this document the User will terminate. User agrees, upon termination, to destroy all copies of any services or documents obtain as part of this agreement. The Limitations of Warranties and Liability set out below shall continue in force even after any termination.  4) LIMITATION OF WARRANTIES AND LIABILITY: The Licensee understands that any maps and data provided hereunder are to be USED FOR REFERENCE USE ONLY. The data contained in the Geographic Information System (GIS) Department is subject to constant change. The data and GIS mapping products under no circumstances shall be used for final design purposes. The City makes no warranties or guarantees as to the information being accurate or complete with knowledge of the forgoing, by proceeding to use this data, each user agrees to waive, release, and indemnify the City, its agents and employees from any claims, actions or causes of action for any damages arising from the incorrect use of our data. In addition, the following limitations of warranties and liability shall specifically apply:  a) Except for the express warranty in (d) above, the city provides geographic information systems (GIS) data and metadata with no claim as to the completeness, usefulness, or accuracy of its content, positional or otherwise. The city and its officials and employees make no warranty, express or implied, and assume no legal liability or responsibility for the ability of users to fulfill their intended purposes in accessing or using GIS data or metadata or for omissions in content regarding such data. The data could include technical inaccuracies and typographical errors. The data is presented \u201cas is,\u201d without any other warranties or conditions, express or implied, including, but not limited to, the implied warranties of merchantable quality, merchant ability or fitness for a particular purpose, non-infringement, or those arising by law, statute, usage of trade, or course of dealing. The entire risk as to the results and performance of the services is assumed by licensee. In providing this data, the city assumes no obligation to assist the licensee in the use of such data or in the development, use, or maintenance of any applications applied to or associated with the data or metadata. b) The city shall have no liability to licensee or any other person or entity for any indirect, incidental, special, or consequential damages whatsoever, including, but not limited to, loss of revenue or profit, lost or damaged data, non infringement of third party rights or other commercial or economic loss, even if the city has been advised of the possibility of such damages, or they are foreseeable. The city is not responsible for claims by a third party. The city\u2019s maximum aggregate liability to licensee and any other person shall not exceed the warranty set forth above. The limitations in this section shall apply whether or not the alleged breach or default is a breach of a fundamental condition or term or a fundamental breach.",
